Dear Mr. President:
On December 10th 1992, on occasion of the XIII Summit of Presidents of Central America, the Presidents of Costa Rica, El Salvador, Honduras, Nicaragua and Panama approved the Convention on the Statute of the Central American Court of Justice.
In the 32 years since its creation, the Central American Court of Justice has been composed only of Judges from the Republics of Nicaragua, Honduras and El Salvador, failing to fulfill the original purposes of its creation as a regional judicial body.
Likewise, both the Statute and the Regulations of the Central American Court of Justice do not respond to the reality of its composition, since against all logic, the Court is subject to the decisions of the Central American and Caribbean Judicial Council, which is not part of the Central American Integration System (SICA), and also to decisions of countries which, despite having approved the Statute, have not carried into effect their will to join the Central American Court of Justice, or countries that are not part of the Statute.
This situation is clearly incoherent and does not allow the development of a Court that responds to a true regional integration in which all SICA member Countries participate fully, on equal terms, assuming their Rights and Obligations, a situation which is unacceptable and unsustainable for Nicaragua.
For the foregoing reasons, the Government of the Republic of Nicaragua transmits its sovereign and irrevocable decision to renounce the Convention on the Statute of the Central American Court of Justice, approved on December 10th 1992 and withdraw from the Central American Court of Justice, as of this date.
In accordance with its Political Constitution, the Republic of Nicaragua reiterates its unwavering will to continue favoring regional integration and advocating the reconstruction of Central American Unity, based on equality and respect for the Sovereignty of States.
