OFFICIAL COMMUNIQUE
The Government of the Republic of Nicaragua, hereby, expressly and publicly condemns the statements of the Secretary General of the Organization of American States (OAS), Mr. Luis Almagro of September 14th, in the town of Cúcuta, Colombia. Specifically, Mr. Almagro stated the following:
"Regarding a military intervention to overthrow the Nicolás Maduro Regime, I think we should not rule out any option."
In a similar line, during the XV Latin American Summit, held in the City of Miami, USA, on September 7th, Mr. Almagro declared:
"We must also be aware that we must not allow it, and that we must, in each case, give the response from the International Community to asphyxiate the dictatorship that is also being installed in Nicaragua."
The Government of Nicaragua, before such dire statements, which call, first for a foreign military intervention against a sovereign State, and second, to asphyxiate the government of another sovereign country, stresses that the Charter of the United Nations (UN) and the OAS Charter, prohibit and expressly proscribe acts that attempt against the territorial integrity, sovereignty and political independence of States.
The Charter of the OAS establishes in its Article 1 the following:
"Article 1
The American States establish by this Charter the international organization that they have developed to achieve an order of peace and justice, to promote their solidarity, to strengthen their collaboration, and to defend their sovereignty, their territorial integrity, and their independence. Within the United Nations, the Organization of American States is a regional agency.
The Organization of American States has no powers other than those expressly conferred upon it by this Charter, none of whose provisions authorizes it to intervene in matters that are within the internal jurisdiction of the Member States."
Article 2, on the other hand, provides that, within the "essential purposes" of the OAS, there are:
a) Strengthen Peace and Security of the Continent;
b) Promote and consolidate representative democracy while respecting the principle of non-intervention;
As is evident, the OAS Charter is clear regarding the defense of the sovereignty, territorial integrity and independence of its member states, being obliged to act in accordance with those principles, hence, as the Charter of the Regional organization states, none of its provisions authorize it to intervene in matters of the internal jurisdiction of the States, still less to promote military interventions against a member state and call the asphyxia of an American government. The Declarations of Mr. Almagro, in his capacity as Secretary General of the OAS, constitute a serious threat to international peace and security and a very serious violation of the most fundamental principles of International Law.
For these reasons, the Republic of Nicaragua expresses its strongest and firm condemnation of the position of the Secretary General of the OAS, and formally denounces his conduct which, in addition to overreaching and failing to fulfill his functions as representative of the regional organization, seriously transgresses the purposes and principles that he is obliged to defend and which constitute the pillars of world peace and law. These Declarations, therefore, disqualify him from continuing to hold the position of Secretary General of the OAS, a position to which he must resign.
